Documents needed to Prove Domestic Abuse for Legal Aid


One or more of the following:-

  1. Proof that your opponent has an unspent conviction for a domestic violence offence.

  2. Proof that your opponent has a police caution for a domestic violence offence within the past 5 years.

  3. Proof of current criminal proceedings against your opponent for a domestic violence offence. This could be a newspaper clipping.

  4. Proof of an injunction against your opponent made by the court within the past 5 years.

  5. Proof of an undertaking given by your opponent to the court in the place of a court injunction within the past 5 years but only if you did not also give a court undertaking.

  6. A letter from a person appointed to chair a MAPPA meeting confirming that you have been referred as a high risk victim of domestic violence and the conference has within the last 2 years put in place a plan to protect you from your opponent.

  7. A copy of a finding of fact in a court within the past 5 years that there has been domestic violence giving rise to a risk of harm to you.

  8. A letter from a health care professional (a doctor or a nurse) confirming that they have examined you within the past 5 years and were satisfied that you had injuries or a condition (could be stress) consistent with being a victim of domestic violence and that they have no reason to believe that your injuries or condition were not caused by domestic violence.   9. A letter from a Social Worker confirming that within the past 5 years, you have been assessed as being, or at risk of being a victim of domestic violence from your opponent (or a copy of any such assessment). Here is a pdf example of a letter that your Social Worker could write.

  10. A letter or report from a domestic violence support organisation to confirm that during the past 2 years, you have been admitted to a refuge for a period of at least 24 hours because of an allegation of domestic violence. The letter must give the dates and here is a pdf example of a letter that such an organisation might write.
